Terms of Service

1. Acceptance of Terms

By accessing or using the TobPhsar platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, merchants, and others who access or use the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

Accounts on TobPhsar are created by platform administrators. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Merchant Obligations

If you operate a shop on TobPhsar, you agree to:

• Provide accurate and complete information about your business and products.
• Fulfill orders in a timely manner and maintain reasonable communication with customers.
• Comply with all applicable laws and regulations in Cambodia, including consumer protection laws.
• Not sell prohibited, counterfeit, or illegal goods or services.
• Maintain accurate pricing and inventory information.
• Handle customer data in accordance with our Privacy Policy and applicable data protection laws.

5. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service or other accounts.
• Upload or transmit viruses, malware, or other malicious code.
• Scrape, data-mine, or extract data from the Service without our written permission.
• Impersonate another person or entity or misrepresent your affiliation with a person or entity.
• Use the Service to send unsolicited communications or spam.

6. Intellectual Property

The TobPhsar platform, including its design, logos, software, and content, is owned by TobPhsar and protected by intellectual property laws. You retain ownership of the content you upload to the platform, but you grant us a non-exclusive, worldwide license to use, display, and distribute that content as necessary to provide the Service.

7. Payment Terms

Subscription fees are billed according to the plan you select. All fees are quoted in US dollars unless otherwise stated. We reserve the right to change our pricing with 30 days' notice. Fees are non-refundable except as required by law. Platform fees, transaction fees, and payment processing charges are separate from subscription fees and will be clearly disclosed.

8. Limitation of Liability

To the maximum extent permitted by law, TobPhsar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

10. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to the competent courts of the Kingdom of Cambodia for resolution.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
